Terms And Conditions For Obtaining A Property To Rent

Viewings

Having considered the information below, appointments must be made through the Residential Lettings Department. All are accompanied by a member of staff.

At least one days notice is required and the applicant must confirm by telephone on the morning of the viewing that they intend to keep the appointment or NWF Kavanagh reserve the right not to attend.

References

Before any applicant can be considered for a residential tenancy of any property managed by ourselves they must provide information to NWF Kavanagh on our Application Form. All information provided will be checked and verified.

Please ensure all application forms are accompanied by the correctly signed and dated cheques.

Please ensure that you inform your employer and all other referees given that they will be contacted.

We may require additional security in the form of a Guarantor in certain circumstances. Should this be necessary then references will have to be raised upon the person nominated and incur an additional administration charge. All applications received are treated by us in good faith and in strict confidence. We would expect applicants to divulge details of any past financial difficulties such as bankruptcy or County Court Judgements which might be revealed as a result of the application being processed.

A separate application form will be required for each applicant 18 years and over intending to occupy the property.

Administration Fee

Signing Of Tenancy Agreement And Payment Of Rentals And Deposits Due

Prospective tenants are advised that it will be necessary to present cleared funds (cash or bankers draft) on the signing of the tenancy agreement for all rentals and deposits. If a cheque payment is to be made it is to be received by NWF Kavanagh 12 working days prior to the proposed commencement of the tenancy. The money will be held to the prospective tenant’s order within NWF Kavanagh client’s account. Should for any reason the tenancy not proceed, the payment will be refunded.

Pets

All tenancy agreements drawn up by NWF Kavanagh strictly exclude pets (i.e. dog, cats, caged birds etc.) from the property unless otherwise agreed in writing.

Tenancies

All tenancies are for a minimum period of 6 months.

Rentals, Payments And Deposits

Rents are paid monthly in advance by standing order and a security deposit usually equal to between 1 and 2 months rent is taken at the commencement of the tenancy. Interest is only paid on deposits exceeding £1,000 and is accountable on termination of the tenancy. NWF Kavanagh is a member of the Tenancy Deposit Scheme and all deposits will be held in accordance with the scheme.

Property Checks And Inventories

Ingoing tenants will be given a copy of the Inventory and Schedule of Condition at the commencement of the Tenancy and will be given the opportunity of checking and agreeing any amendments to the document. The return of deposits at the termination of the tenancy will be dependant upon the condition of the property as described in the Inventory and Schedule of Condition. Under no circumstances can the deposit be used as a final rental payment and court proceedings will commence during the final month of any tenancy should any rental payment not be met and paid in full. All properties managed by NWF Kavanagh are subject to internal and external checks every 12-14 weeks. It is a condition of the Tenancy that the Tenant(s) MUST make arrangements for access to be made available during OFFICE HOURS.

Notice To Quit

Notice given by the tenant for the termination of the tenancy must be for a minimum of 1 month from the rental date, the service of which must be made in writing. In respect of Assured Shorthold Tenancies this period of notice is different should the landlord wish to terminate the agreement. Please enquire if you require further details.

Services

As a prospective tenant you are responsible for payment of electricity, gas, oil, water, council tax and telephone. All rents are per calendar month and are exclusive of all outgoings unless otherwise stated.

Data Protection Act (1998)

The information you have provided on this form will be used to process your application. It will be held securely and used in connection with your application/tenancy. All or part of the information provided may be disclosed or supplied to external organisations that are legally entitled to the information. NWF Kavanagh may also obtain information from third parties or provide information to them to check the accuracy of information supplied by you to NWF Kavanagh. NWF Kavanagh may make a search (including making enquiries about principle directors) with a Credit Reference Agency. The Credit Reference Agency will keep a record of that search and may share the information with other businesses.
